About this policy

Every painting sold through this website is a one-of-a-kind original oil painting on canvas.

This policy explains how paintings are shipped, the applicable delivery costs, the right of withdrawal, returns, refunds, damaged shipments and lost shipments. It forms part of the Terms of Sale.

How paintings are shipped

Your painting travels the way it was made: stretched on its wooden frame and ready to hang. Paintings are not rolled.

Fine art prints are the one exception to the packing described on this page: a print is not stretched on a wooden frame, so it is packed in rigid protective packaging suited to its size, and the exact method is confirmed with you for your order. Everything else below — carriers, tracking, insurance, delivery times, customs, withdrawal and refunds — applies to prints in the same way.

Dispatch and delivery

Paintings that are ready for sale are normally dispatched after payment has been confirmed and after the painting is sufficiently dry and safe to pack. Order preparation usually takes 3–7 business days after payment has been confirmed, and in most cases orders are dispatched on Mondays. If a painting has been completed recently and requires additional drying time, the estimated shipping date is communicated to you in advance.

The estimated dispatch or delivery information communicated for an individual order is an estimate and not a guaranteed delivery date unless we expressly confirm otherwise in writing. Delivery time depends on the destination, the carrier, customs procedures, weather conditions and other circumstances outside our reasonable control.

Unless a different delivery period has been expressly agreed with you, the painting will be delivered without undue delay and no later than 30 days after the conclusion of the contract.

As soon as the painting has been dispatched, you receive the available tracking information by email, so please make sure the email address you give at checkout is one you actually read.

You are responsible for providing a complete and correct delivery address and for monitoring communications from the carrier.

The risk of accidental loss or damage remains with us until the painting is physically received by you or by another person designated by you, other than the carrier. If you independently appoint a carrier that was not offered by us, the risk passes to you when the painting is handed over to that carrier.

Shipping prices

Shipping is charged according to the delivery destination. The applicable shipping charge is shown before payment. Current shipping charges are:

We do not ship to Russia or Belarus. For some remote or uncommon destinations, shipping availability, carrier, delivery time and shipping cost may be confirmed with you before the order is accepted.

Prices and shipping charges on the website are shown in euros. The price displayed for a painting is the total price payable for that painting, inclusive of any taxes applicable to the sale in Spain; the shipping charge for your destination is added at checkout.

Payment is processed securely by Stripe. This website does not receive or store your complete payment-card details.

Customs, import duties and taxes

No customs import formalities normally apply to deliveries within the European Union.

For deliveries outside the European Union, the destination country may impose import duties, import VAT, customs-clearance charges or other taxes and fees. Unless the checkout or the individual order confirmation expressly states that such charges are included, these charges are not collected by us and must be paid by the buyer.

Customs rules, thresholds and charges are determined by the authorities of the destination country and may change. Please obtain information from the relevant customs authority before ordering if these costs matter to your purchasing decision.

You must provide any information reasonably requested by the carrier or the customs authority and must complete the necessary import formalities.

A refusal to pay lawful import charges, a refusal to cooperate with customs or a failure to collect the shipment does not automatically cancel the contract or remove your responsibility for the costs caused by the return of the shipment. Any refund in such a case is determined after the painting has been safely returned to us, and may be reduced by direct return-transport, storage, customs or handling costs lawfully incurred by us, to the extent permitted by applicable mandatory law.

Right of withdrawal for catalogue paintings

A consumer who is legally entitled to the European Union or United Kingdom right of withdrawal may withdraw from the purchase of a catalogue painting without giving a reason.

The withdrawal period expires 14 days after the day on which you, or a third party designated by you other than the carrier, physically receives the painting.

To exercise the right of withdrawal, send a clear statement before the withdrawal period expires to contact@myriyevskyy.com. You may simply state by email that you wish to withdraw from the purchase. We will acknowledge the notice and provide or confirm the return instructions.

Consumers outside the European Union and the United Kingdom do not have a voluntary change-of-mind return right under this policy, unless such a right is required by mandatory law applicable to the purchase or is expressly agreed by us in writing. This does not affect any rights relating to a painting that is damaged, defective or not as described.

Returning a catalogue painting

After giving notice of withdrawal, you must send the painting back without undue delay and no later than 14 days after notifying us of the withdrawal.

Before sending the painting, please contact us at contact@myriyevskyy.com so that the return and its packaging can be properly coordinated.

Refunds following withdrawal

We will reimburse the payments that must legally be refunded without undue delay and no later than 14 days after being informed of your decision to withdraw.

However, we may withhold the reimbursement until:

whichever occurs first.

Evidence of shipment must be sufficient to identify the returned parcel, the carrier, the date of shipment and the correct return address. An incomplete, invalid or unverifiable tracking number is not sufficient evidence. This rule does not make us responsible for errors by the buyer when preparing or addressing the return shipment.

The refund is made using the same payment method used for the original transaction unless you expressly agree otherwise. You are not charged a refund administration fee.

Where you paid for outbound delivery, we refund the cost of the least expensive standard delivery option offered for the order, where required by applicable law. Any additional amount paid for a more expensive delivery method you selected does not have to be refunded. Delivery to the European Union and the United Kingdom is free, so in those cases there is no outbound delivery charge to add back.

Commissioned and personalised paintings

The statutory right of withdrawal does not apply to paintings made to the buyer's specifications or clearly personalised.

A commissioned painting may include, for example, a particular person, couple, family, animal, place, size, composition, colour scheme or other characteristics requested by the buyer.

The subject, dimensions, price, artistic direction, expected stages and approximate timing of a commission are agreed in writing before work begins. The creation time for a commissioned painting is agreed individually with you before work begins.

Once work on a commissioned or personalised painting has begun, the order cannot be cancelled merely because you have changed your mind.

The exclusion of the right of withdrawal does not affect your mandatory rights if the commissioned painting is damaged, defective or materially different from what was agreed.

If a painting arrives damaged

Every shipment is insured, and the risk of accidental transport damage normally remains with us until the painting is received by you or your designated recipient.

If the outer packaging is visibly damaged at delivery, you should, where reasonably possible:

Notify us at contact@myriyevskyy.com, preferably within 72 hours after delivery, including the photographs, your order details and a description of the damage.

The 72-hour period is requested so that we can promptly preserve evidence and make an effective insurance claim. Failure to report within 72 hours does not remove any mandatory statutory rights.

Please retain the painting and all original packaging while the matter is investigated, and do not repair, alter, discard or return the painting without written instructions from us.

Depending on the circumstances and your applicable statutory rights, the solution may include:

Because each catalogue painting is unique, an identical replacement will normally not be possible.

We bear the reasonable cost of returning a painting that arrived damaged, defective or materially different from its description, where this is required by applicable law. Please do not arrange an unnecessarily expensive return method without first giving us a reasonable opportunity to organise or approve the return.

Late or lost shipments

If tracking has not updated or delivery is clearly overdue, contact contact@myriyevskyy.com with your order details. Before you do, it is worth checking the tracking number we emailed you and whether the carrier left the parcel with a neighbour or at a pickup point.

We will open an investigation with the carrier as soon as the carrier's applicable procedures permit.

International carriers may require a waiting or investigation period before a shipment can officially be declared lost. For this reason we do not promise that a shipment will be legally or operationally treated as lost after a fixed number of days. A delay, a customs hold or a temporary absence of tracking updates does not by itself prove that the shipment is lost — outside the EU, a parcel sitting still for days is often waiting on customs clearance.

If the carrier confirms that the painting has been lost, you receive the remedy required by applicable law, normally a full refund. You are not required to wait until the carrier or insurer has paid compensation to us before receiving a refund that is already legally due.

This section does not limit your mandatory rights where delivery has not occurred within the agreed period or within the maximum period established by applicable law.

Applicable law and consumer rights

These Shipping & Returns Terms are governed by the laws of Spain.

Where the buyer is a consumer, this choice of law does not deprive the buyer of any mandatory protection provided by the law of the country in which the buyer habitually resides, where that protection applies under the relevant conflict-of-law rules.

Nothing in this policy excludes, restricts or replaces mandatory consumer rights. If a painting is damaged, defective, not as described or otherwise not in conformity with the contract, the buyer retains all remedies provided by applicable mandatory law. Under Spanish law the legal guarantee of conformity runs for three years from delivery; buyers resident in another country keep at least the minimum period their own law provides (two years across the European Union).

If any provision of this policy is found to be invalid or unenforceable, the remaining provisions continue to apply to the fullest extent permitted by law.

Questions or complaints should first be sent to contact@myriyevskyy.com. If a complaint cannot be settled between us, consumers may address the consumer protection authorities of their own country and may use any out-of-court dispute resolution (ADR) body competent in their country of residence. The European Commission's online dispute resolution (ODR) platform ceased to operate on 20 July 2025 and is therefore no longer available. Consumers in Catalonia may also request the official complaint form (full oficial de queixa, reclamació i denúncia) by writing to the address above.
